DGFT initiates Anti-Dumping Investigation on Poly Vinyl Chloride Paste Resin from 6 Countries [Read Notification]

The Directorate General of Foreign Trade (DGFT) vide Case No – AD(OI) – 16/2023 issued on 3rd October 2023 has notified the initiation of anti-dumping investigation on Poly Vinyl Chloride Paste Resin from China PR, Korea RP, Malaysia, Norway, Taiwan and Thailand. The applicant, M/s Chemplast Sanmar Limited has alleged that material injury is being caused to the domestic industry due to the alleged dumped imports, originating in or exported from the subject countries and has requested for the imposition of antidumping duties on the imports of the subject goods from the subject countries. Product under Consideration The product under consideration is ‘Poly Vinyl Chloride Paste Resin’ also known as Emulsion PVC Resin. It is classified under Chapter 39 of the Customs Tariff Act, 1975 under subheading 390410 of the Tariff Classification and has a dedicated classification under ITC HS Code 39041010. The customs classification is indicative only and not binding on the scope of the product under consideration for the proposed investigation. Subject Country The subject countries in the present investigation are China PR, Korea RP, Malaysia, Norway, Taiwan and Thailand. Period of Investigation The period of investigation (POI) for the investigation is from April 2022 to March 2023 (12 months). The injury examination period is 1st April 2019 to 31st March 2020, 1st April 2020 to 31st March 2021, 1st April 2021 to 31st March 2022, and the POI. Injury and Causal Link The applicant has provided prima facie evidence with respect to the injury suffered by the domestic industry because of the dumped imports. The volume of the subject imports from the subject countries is significant in absolute as well as relative terms. The applicant contended that the subject imports have had an adverse impact on the profitability parameters of the domestic industry due to which the cash profits, PBIT, and ROCE have registered a very significant decline. The price undercutting from the subject countries as a whole is positive. The price suppression and depression caused by dumped imports have been preventing the domestic industry from increasing its prices to recover the full cost and achieve a reasonable rate of return. There has also been an increase in the inventory levels of the domestic industry during POI as compared to the previous year. Submission of Information All communication should be sent to the Designated Authority via email at email addresses dd11- dgtr@gov.in and ddl6-dgtr@gov.in with a copy to adg14-dgtr@gov.in and adv13-dgtr@gov.in. It must be ensured that the narrative part of the submission is in searchable PDF/MS-Word format and data files are in MS-Excel format. Producers/exporters, the subject countries' governments via their Embassy in India, and Indian importers/users linked to the subject goods are notified individually to provide necessary information within specified timeframes. This data should be submitted following the guidelines outlined in this initiation notification, the Rules, and relevant trade notices issued by the Authority. Any other interested party may also make a submission relevant to the present investigation in the form and manner as prescribed by this initiation notification, the Rules, and the applicable trade notices issued by the Authority within the time limits mentioned in this initiation notification. It is advised to send all information regarding the ongoing investigation to the Designated Authority at dd11-dgtr@gov.in and dd16-dgtr@gov.in , with a copy to adg14-dgtr@gov.in and adv13-dgtr@gov.in within 30 days from when the non-confidential documents filed by the domestic industry are circulated or transmitted to the exporting countries' diplomatic representatives, as per Rule 6(4) of the Rules. Failure to provide information within this timeframe may lead to the Authority making its findings based on available records and in accordance with the Rules.
