DGFT issues Procedure for Telecommunication Items Export Authorization under SCOMET Category 8A5 Part I [Read Notification]

The Directorate General of Foreign Trade ( DGFT ) has issued a public notice, number 52/2023 dated 27th March 2024, outlining the procedure for obtaining export authorization for telecommunication-related items falling under SCOMET category 8A5 Part 1.

This notification, in exercise of the powers conferred under Paragraph 1.03 and 2.01 of the Foreign Trade Policy (FTP) 2023, brings about an amendment to Chapter 10 of the Handbook of Procedures ( HBP ) 2023, effective immediately.

Under Para 10.15(1), a General Authorization for Export of Telecommunication-related items under SCOMET Category 8A5 Part 1 ( GAET ) has been introduced, streamlining the export process for indigenous or imported SCOMET items, subject to specific conditions.

Key points of the notification include:

1. Exemption from SCOMET authorization for the export and/or re-export of telecommunication items (excluding technology and software) under SCOMET Category 8A5 Part I, except for items listed in Annexure-I.
2. Submission of a one-time license application under GAET through the online SCOMET portal, accompanied by prescribed information.
3. Review and examination of applications by the Inter-Ministerial Working Group (IMWG) based on detailed item descriptions, End-user certificates (EUCs), and other supporting documents.
4. Requirements for certified internal compliance programs, Authorized Economic Operator (AEO) T2 Certification of CBIC, and additional documentation for re-export of imported items.
5. Obligations for exporters to notify relevant government authorities, submit post-shipment details, and maintain records for a specified period.
6. General conditions and exclusions regarding military applications, UNSC embargoed countries, and proliferation concerns.
7. Validity of GAET for three years from the date of issue, with provisions for suspension or revocation for non-compliance.
