The Government rescinded the Custom Notification imposing 12% IGST on Oxygen concentrators, imported for personal use.
This notification is a result of the 44th GST Council met under the Chairmanship of Union Finance & Corporate Affairs Minister Smt. Nirmala Sitharaman via video conferencing on 12th June, 2021 via video conferencing in New Delhi.
In the meeting the Finance Minister proposed that the tax rate on ventilators, medical grade oxygen, COVID-19 testing kits, oxygen concentrators and BiPAP machines have been brought down to 5 percent from 12 percent at present.
āIn exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962) and section 3 of the Customs Tariff Act, 1975 (51 of 1975), the Central Government, on being satisfied that it is necessary in the public interest so to do, hereby rescinds the notification of the Government of India in the Ministry of Finance (Department of Revenue) No. 30/2021- Customs, dated the 1st May, 2021 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 313(E), dated the 1st May, 2021, except as respects things done or omitted to be done before such rescission,ā the notification said.
The Notification No. 30/2021-Customs dated 1st May, 2021 says that Oxygen concentrator, imported for personal use falling within the 9804 Chapter, heading, subāheading or tariff item of the First Schedule to the Customs Tariff Act, 1975 when imported into India, from so much of the integrated tax leviable thereon under sub-section (7) of section 3 of the said Customs Tariff Act, read with section 5 of the Integrated Goods and Services Tax Act, 2017, as is in excess of the amount calculated at the rate of 12%.
