The GST Council in its 50th meeting had recommended that ISD (Input Service Distributor) procedure as laid down in Section 20 of the CGST Act, 2017 may be made mandatory prospectively for distribution of ITC in respect of input services procured by Head Office (HO) from a third party but attributable to both HO and Branch Office (BO) or exclusively to one or more BOs.

The Council has now recommended amendments in Section 2(61) and section 20 of CGST Act, 2017 as well amendment in rule 39 of CGST Rules, 2017 in respect of the same.

The council has put forth recommendations to modify the eligibility criteria for the President and Members of the Goods and Services Tax Appellate Tribunal (GSTAT) concerning their age. These recommendations involve raising the maximum age limit for the President from 67 years to 70 years, and for the members, from 65 years to 67 years.

Furthermore, the council has introduced a new provision that allows advocates with a minimum of ten years of experience and a minimum age of 50 years to be appointed as ‘Judicial Members’ rather than ‘Technical Members.’Read More: GSTAT President’s Maximum Tenure Age Set at 70 and Members at 67; GST Council Opens Doors for Advocates as Judicial Members
