GST Council Recommends Monetary Limits for GST Appeal Filing by GST Department

The department can file the GST appeals only if these monetary limits are satisfied

The 53rd GST council has recommended the monetary limit for GST Appeals for filing of appeals by the GST ( Goods and Services Tax ) department before the GST Appellate Tribunal ( GSTAT ), High Courts and Supreme Court.

The Union Finance Minister Nirmala Sitaraman presided over the 53rd meeting of the GST Council today (22nd June 2024) at New Delhi with Revenue Secretary and CBIC Chairman. The meeting commenced at 2:00 PM, however, the Finance Minister addressed the public in the evening.

The Monetary limits recommended are:

  1. GSTAT – 20 lakhs
  2. High Courts – 1 Crore
  3. Supreme Court – 2 Crores

The department can file the GST appeals only if these monetary limits are satisfied. This is a taxpayer friendly decision by the GST council meeting. This is to reduce the government litigation.

Recently, the CBIC has issued a significant update on government litigation, setting new monetary limits for filing appeals before the Customs, Excise, and Service Tax Appellate Tribunal (CESTAT), High Courts, and the Supreme Court have been established. The new limits are as follows: Supreme Court: Rs. 2 Crore High Courts: Rs. 1 Crore CESTAT: Rs. 50 Lakh.
