The Rajasthan High Court, on Monday issued an interim order protecting a person from arrest and directed him to appear before the authorities in response to the summon received under section 70 of the Central GST Act, 2017.
Mr. Ritik Arora, the petitioner, received summons under Section 70 of the Central Goods and Service Tax Act, 2017 have already been issued to the petitioner for so many times. However, the petitioner did not appear before the concerned authority apprehending his arrest.
Justice Rameshwar Vyas observed that “In the facts and circumstances of the present case, the petitioner is directed to join the enquiry and make himself available before the competent authority on the date given by the authority concerned and respond to the summon issued under Section 70. After appearance of the petitioner, the concerned authority will act as per law.”
Listing the matter to 22nd August, the Court held that “Meanwhile and till next date, the petitioner shall not be arrested in this case.”
