The Ministry of Corporate Affairs (MCA) notified the Companies (Incorporation) Fourth Amendment Rules, 2021 wherein the changes in e-Form INC-35 are notified.
The notification seeks to amend the Companies (Incorporation) Rules, 2014.
In the Companies (Incorporation) Rules, 2014 (hereinafter referred to as the said rules), in rule 38A, (i) in the marginal heading, for the words, “and Opening of Bank Account”, the words, “Opening of Bank Account and Shops and Establishment Registration”, shall be substituted.
In other words, Application for registration of Goods and Service Tax Identification Number (GSTIN), Employee State Insurance Corporation (ESIC) registration and Employees’ Provident Fund Organisation (EPFO) Registration , Employees’ Provident Fund organisation (EPFO) Registration and Profession Tax Registration Opening of Bank Account and Shops and Establishment Registration.
In the opening portion, for the letters “AGILE-PRO”, the letters “AGILE-PRO-S” shall be substituted.
The phrase ‘AGILE-PRO-S’ refers to the Application for Goods and Service Tax Identification Number, employees state Insurance corporation registration plus Employees Provident Fund Organisation registration, Profession Tax Registration, opening of bank account and shop and establishment registration.
For clauses “(c) and (d)” relating to “Profession Tax Registration and Opening of Bank Account”, the various clauses shall be substituted, namely ” Profession Tax Registration with effect from the 23rd February, 2020; Opening Bank Account with effect from the 23rd February, 2020; Shops and Establishment Registration.”.
The Ministry has notified changes in e-Form No.INC-35 and instead of “AGILE-PRO”, the letters “AGILE-PRO-S” was inserted wherein opening of bank account and shop and establishment registration has been added.
