CA Qualification without Graduation and LLB Admission
According to BCI regulations, you must have a graduation in order to enrol in a 3-year legal programme; if not, you must choose a 5-year legal degree. On March 16, 2021, the Institute of Chartered Accountants of India (ICAI) released a press release stating that the chartered accountancy qualification is equivalent to the postgraduate degree. Thus, the CAs who don’t have a graduation are eligible to pursue a three-year legal degree.
Regarding the admission requirements for LLB, the Bar Council of India (BCI) is the statutory body to decide. However, CA Amil Kumar, a qualified Chartered Accountant with a CA degree from the institute of chartered accountants of India (ICAI), aspirant to become a lawyer had recently approached the Kerala High Court, aggrieved by the rejection of LLB admission by a College affiliated to the University of Calicut, stating that “CA is not a graduation.” The BCI is still silent on this matter. Thus, this must be a long deliberative topic. Both the bodies have to put an effort to clear this for the well-being of their members and also individuals who want to acquire knowledge.
Currently, If you have a graduation with CA qualification, then no issues for 3-year law course. If you don’t have graduation, you have to go for a 5-year LLB course. A CA student can pursue LLB simultaneously.
Really need to take a Law Degree for Legal Expertise?
A practicing Chartered Accountant (CA) does not necessarily require a law degree to attain legal proficiency. While pursuing a legal education, one must study a wide range of domestic laws, some of which may not be directly relevant to their CA profession.
